Transgender Rights Are Human Rights
The proposed federal changes also undermine the rights at our gay, bisexual and lesbian patients, staff and community. Earlier this week, the NY Times reported that the Department of Health and Human Services intends to narrow the federal government’s definition of “sex” under Title IX — a change that could remove legal protections for transgender people that have become standard in recent years. It was also reported that HHS wants to establish a uniform definition accepted by the four agencies that enforce Title IX: the departments of Education, Justice, HHS and Labor.
Title IX is the federal law passed as part of the Education Amendments of 1972 that prohibits discrimination on the basis of sex “under any education program or activity receiving Federal financial assistance.” The term “sex” refers to gender, which has since been expanded under the law to include sexual orientation and gender identity.
